Bereavement Leave: Entitlement and Rules

Every farewell takes time. And the newly amended law takes this into account.

The passing of a loved one brings with it the need for space – space for peace, for presence, for words that often remain only within us. The new amendment to the law, which entered into force on June 1, 2025, reflects this need and offers greater understanding for the bereaved.

Changes to the Labor Code and related regulations bring adjustments to entitlements to time off work in the event of the death of a loved one. Now it is no longer just a matter of “necessary time”. Survivors are entitled to a precisely defined time that they can use according to their needs. Without pressure and without having to prove anything.

What the amendment brings in force from 1 June 2025?

In the event of the death of a husband, wife, partner or child:

• 3 days of paid leave (of which 1 day is reserved for attending the ceremony),
• up to 5 days of unpaid leave (at the request of the bereaved; it is not mandatory to use it).

In the event of the death of a parent, grandparent, sibling or grandchild (including relatives on the part of a partner or person living in a common household):

• 1 day of paid leave to attend the ceremony (if the employee also arranges for the funeral, he is entitled to another 1 day of paid leave),
• in the event of the death of a grandchild, parent, grandparent or sibling, up to 5 days of unpaid leave (again at the request of the bereaved).

Other important changes

• No proof of presence is necessary

There is no need to prove how long you were present at the ceremony. What matters is the need to say goodbye, not the length of time you attended.

• Equality of registered partners

The amendment explicitly states that the term “spouse” also includes registered partners. The rights are therefore the same.
