Information about the processing and protection of your personal data

Personal data protection policy of the Funeral Service PEGAS CZ s.r.o.

Funeral Service PEGAS CZ s.r.o., Company ID: 256 31 845, with its registered office at V úvalu 87/18, Motol, 150 00 Prague 5, registered in the Commercial Register at the Municipal Court in Prague, Section C, File 56424, represented by Ing. Jiří Haman, Managing Director (hereinafter referred to as “We” or “Company”) as the controller of personal data, is committed to protecting your privacy and hereby informs you about the collection and processing of personal data and the privacy policy specified below. After reading the following information, you will learn more about how we collect, store and use personal data about you when you enter into an order agreement or other contract for the provision of our services, when you contact our Company, as well as when you interact with or use our website (https://www.pohrebpegas.cz) or in any related activity.

1) What personal data do we process?

If you conclude a mandate contract or other service contract with us, we may collect and process your personal data about you, as well as, where applicable, the data of other persons that you provide to us in connection with the contract (e.g. data about the surviving spouse and surviving parents of the deceased person, if you wish us to ensure that a death certificate is issued for you, or data about your family members or other close persons to whom you wish to notify more detailed information about your last farewell). The provision of certain personal data listed below is necessary for the purposes of concluding and performing the mandate contract or other service contract.
Our company processes only personal data that you provide to us and personal data that the Company obtains in connection with the provision of services. If you do not provide us with personal data to the extent necessary for concluding and performing the contract or fulfilling legal obligations, this fact is a reason for not concluding the contract.

The personal data that our Company processes may include, in particular:

  1. first and last name;
  2. permanent address;
  3. personal ID;
  4. phone number;
  5. email address;
  6. relationship to the deceased person.

Personal data about the surviving spouse and surviving parents of the deceased person that our Company processes if you wish us to ensure the preparation of a death certificate for you and the preparation of a death certificate may include, in particular:

  1. first and last name;
  2. personal ID;
  3. date of marriage and other information contained in the marriage certificate.

If you do not provide us with this personal data of the listed persons, we cannot prepare a death certificate for you or ensure the preparation of a death certificate.

Personal data about your family members, to whom you wish to inform more details about your final farewell, may include, in particular:

  1. first and last name;
  2. permanent address.

If you do not provide us with this personal data of the aforementioned persons, we will not be able to fulfill your wish to contact the aforementioned persons in the event of your final farewell according to the concluded contract.

If you decide to contact us without concluding any contract with us (e.g. via e-mail, contact form located on our website, telephone call, etc.), our Company only processes personal data that you voluntarily provide to us (e.g. for the purpose of preparing a specific offer of our services or goods for you or to contact you back with an answer to your question). If you contact us via the website, especially if you use our contact form, you may be asked to fill in certain information about yourself. This information may include, in particular:

  1. Your first and last name;
  2. Your residential address;
  3. Phone number;
  4. Email address.

Failure to provide the above information may result in your inquiry not being answered.
Providing your personal information, including your name and surname, your residential address (or contact address), telephone number and e-mail address, is necessary for us to contact you if you have expressed interest in the services or goods advertised on our website via the appropriate contact form, in order to arrange a date and place for a personal meeting to arrange a funeral. 2) How do we use this personal data (purpose of processing)?

We use all data that you provide to us, e.g. via our website, telephone call, etc., only for the purpose of fulfilling the contract. The provision of personal data for the purpose of fulfilling the contract is our contractual requirement and failure to provide it may result in the contract not being concluded or the impossibility of its proper fulfillment due to your fault.

If you have not yet concluded a contract with us, then we use all the data you provide to us via our website, e-mail message, contact form, telephone call, etc. only to contact you back and provide you with the information you have requested, i.e. to familiarize you with the specific offer of the service or goods you have chosen or to agree with you on the date and place of a personal meeting to arrange a funeral, etc. If you accept the offer of services or goods we have prepared, we will also use your data to conclude and subsequently fulfill the contract.

We are also entitled to process your personal data for the purpose of fulfilling other statutory obligations imposed on our Company by special legal regulations, or for the purpose of protecting the legitimate interests of our Company or a third party, if such processing is necessary.

3) Who has access to your personal data?

Your personal data is processed by our Company as the controller, and access to your personal data is only available to employees of our Company authorized to process personal data, who are obliged to maintain confidentiality of all personal data that they become aware of in the course of their work for our Company. This confidentiality continues even after the termination of the employment relationship or other similar relationship. Your personal data may also be transferred to our subcontractors for the purposes specified above (in particular, the proper performance of the concluded contract, or for the purpose of fulfilling the Company’s legal obligations), to carry out processing for the Company, only to the extent necessary and in accordance with legal regulations. We may also make your personal data available to authorized third parties in accordance with relevant legal regulations, in particular public authorities (e.g. authorities active in criminal proceedings, etc.).

We do not provide or sell your personal data to third parties, with the exception of the entities specified above that perform the relevant processing for us.

4) What is the processing time of your personal data?

We process your personal data for the period strictly necessary, i.e. for the period during which we provide you with our services or fulfill a mutual contract, or for the period necessary to fulfill archiving or other obligations under applicable legal regulations, such as the Value Added Tax Act, the Accounting Act or the Archives Act. After the termination (or fulfillment) of the contract, we may also store your personal data for the purpose of protecting the legitimate interests of the Company, namely for the duration of the limitation periods, or also for the duration of the procedural deadlines intended to exercise our or your rights in any legal or other proceedings.
The Company processes personal data about the surviving spouse, the surviving parents of the deceased person or other surviving family members, or other persons to whom you wish to notify the facts regarding your last farewell, for the period strictly necessary, but no longer than for the duration of the relevant contract. After this period, personal data may be stored only for tax, accounting or other legal purposes (i.e. fulfillment of the Administrator’s legal obligations), to the extent specified by the relevant legal regulations, and also for the purpose of protecting the legitimate interests of the Company.

If you have not concluded a contract with us and have only contacted us with your question, comment, request, etc., then your personal data is processed for the period necessary to handle your request and also for a reasonable period thereafter in order to protect the legitimate interests of our Company, e.g. for the duration of limitation periods. If you subsequently conclude a contract with us, your personal data will be processed for the duration of the contract and for a certain period thereafter, see also above.

5) How is your personal data secured??

Our Company uses appropriate technical, organizational and administrative security measures to protect your personal data. These measures protect your personal data from loss, misuse, unauthorized access, disclosure, alteration or destruction.

6) What are your rights in relation to the protection of personal data?

Your rights regarding our processing of your personal data are as follows:

  1. Right to access your personal data;
  2. Right to rectify your personal data;
  3. Right to erase your personal data;
  4. Right to restrict the processing of your personal data;
  5. Right to portability of your personal data;
  6. Right to withdraw consent to the processing of personal data where the lawfulness of the processing is based on consent to the processing of personal data;
  7. Right to object to the processing of your personal data;
  8. Right to lodge a complaint about the processing of your personal data.

A complaint pursuant to point 8 can be filed with the Office for Personal Data Protection, website: www.uoou.cz.

a) Right to access personal data

This right includes the possibility of requesting confirmation from us at any time whether or not your personal data is being processed, and if so, for what purposes, to what extent, to whom it is made available, for how long it will be processed, from what source the personal data was obtained, whether automated decision-making is carried out based on the processing of your personal data, including profiling, and finally whether there is a right to correction, deletion, restriction of processing or to object to the processing of your personal data.

b) The right to correct your personal data

This right includes the possibility of requesting us to correct or supplement your personal data at any time if it is inaccurate or incomplete.

c) Right to erasure of your personal data

The content of this right is our obligation to erase your personal data, in particular if:

  1. They are no longer necessary for the purposes for which they were collected or otherwise processed;
  2. You object to the processing and there are no legitimate grounds for the processing;
  3. The processing is unlawful;
  4. We are under a legal obligation to erase your personal data.

d) Right to restrict the processing of your personal data

The content of this right is that in the event of certain disputed issues regarding the processing of your personal data, we are obliged to restrict the processing of your personal data if you ask us to do so. This restriction means that we will mark the personal data you have selected and ensure that they are no longer processed other than by storing them. This does not apply if any of the exceptions foreseen by law apply.

The disputed issues in the sense of the above are the fact that:

  1. You contest the accuracy of the personal data, and the processing of the personal data will be restricted for the period necessary to verify the accuracy of the personal data processing;
  2. The processing is unlawful and you oppose the erasure of the personal data and request the restriction of their use instead;
  3. The Company no longer needs your personal data for the purposes of the processing, but you require these personal data for the establishment, exercise or defence of legal claims (the right to restriction of processing thus protects your interests, as the Company prohibits their erasure) or
  4. You have objected to the processing of the personal data, and the processing of the personal data will be restricted until it is verified whether the legitimate grounds of the Company outweigh your legitimate grounds.

If the reasons for restricting the processing of your personal data cease to exist, the restriction on processing will be lifted immediately by the Company.

e) Right to data portability

This right means that if you have provided us with personal data concerning you, you have the right to request that we transmit that data directly to another data controller, in a structured, commonly used and machine-readable format, provided that:

  1. the processing of personal data is carried out by automated means within the Company;
    and at the same time
  2. the processing is based on consent to the processing of personal data or on the conclusion or performance of a contract.

f) Right to withdraw consent to the processing of personal data

For some categories of personal data, it is necessary for you to give your consent to the processing of personal data for one or more specific purposes.

If you have given your consent to the processing of selected categories of personal data, the processing of which is not necessary for the purposes of fulfilling a contract, fulfilling the Company’s legal obligation, protecting the important interests of the Company or another natural person, fulfilling a task carried out in the public interest or in the exercise of public authority, or for the purposes of protecting the Company’s legitimate interests, you are entitled to withdraw your consent to the processing of personal data at any time.

If you wish to withdraw your consent to the processing of selected categories of personal data to which you have previously given your express consent, it is sufficient to visit one of our branches during opening hours, the addresses of which are listed on our website https://www.pohrebpegas.cz, personally contact our employee or send an e-mail message in which you withdraw your consent to the processing of selected categories of personal data to gdpr@pegascz.com, indicating the personal data that you do not want us to process any longer. To speed up the processing of your request, we recommend that you include “withdrawal of consent to the processing of personal data” in the subject line of the e-mail message.

The withdrawal of consent does not affect the lawfulness of processing based on consent given before its withdrawal. The withdrawal of consent also does not affect the processing of personal data that the Company processes on the basis of another legal title.

However, we would like to point out that we currently process your personal data primarily on the basis of legal grounds other than your consent to its processing (for more details, see points 1 and 2 of this document above). You can therefore practically exercise this right if you have previously contacted us, for example via e-mail with your question, suggestion or comment, if you have not previously concluded a contract with us in which you provided us with your e-mail address as a mandatory requirement of the contract.

g) The right to object to the processing of your personal data

This right includes the possibility of raising an objection on your part against the processing of your personal data, which we continue to process after the termination of the provision of services on the basis of a legitimate interest. The Company’s legitimate interest may, for example, be the retention of personal data for the purpose of effectively defending the Company in a potential dispute with the client, e.g. on the manner of performance of the mandate contract. For these purposes, the Company is entitled to retain the client’s personal data for a reasonable period after the termination of the provision of services, as the client’s personal data may enable the Company to defend its rights and legitimate interests in a potential dispute.

The Company is not entitled to continue to process your personal data unless it demonstrates compelling legitimate grounds for the processing which override your interests or rights, or for the establishment, exercise or defence of legal claims.
